AI regulation in Bermuda: laws & policy (2026)
AI in Bermuda: guidelines only.
Bermuda does not have a dedicated, binding AI law. In March 2025 the Government adopted an internal AI Policy for public-sector use built on 'human-in-the-loop', PIPA/PATI compliance, explainability and audit principles, and in July 2025 the Bermuda Monetary Authority issued a discussion paper on responsible AI in financial services outlining a principles-based, proportionate approach (final proposal expected in Q3 2026). AI activities are otherwise governed indirectly through PIPA (data protection), existing prudential/conduct rules and general law.
Legal framework
Government of Bermuda Artificial Intelligence (AI) Policy (adopted March 2025, applying to public sector use) complemented by the Bermuda Monetary Authority (BMA) Discussion Paper on the Responsible Use of AI in Bermuda's Financial Services Sector (30 July 2025, still in consultation). No comprehensive AI statute is in force; the Personal Information Protection Act (PIPA) and existing sectoral rules apply where AI processes personal data.
Key points: artificial intelligence in Bermuda
Government AI Policy (public sector)
The Cabinet Office / Ministry of Digital Innovation adopted a comprehensive AI Policy on 28 March 2025 that applies to government employees and consultants using AI for official purposes. It requires human-in-the-loop review of AI decisions affecting rights or services, PIPA and PATI compliance, transparency/explainability, regular risk assessments and an AI governance sub-committee overseeing phased pilots.
BMA Discussion Paper on AI in financial services
On 30 July 2025 the Bermuda Monetary Authority published 'The Responsible Use of Artificial Intelligence in Bermuda's Financial Services Sector' — a principles-based discussion paper covering board accountability, risk-based assessments (impact, autonomy, data sensitivity), model validation, explainability, human oversight, cybersecurity and treatment of generative/agentic AI. Consultation closed 30 September 2025; further consultation is due in Q1 2026 with a final proposal targeted for Q3 2026.
No comprehensive AI statute
Bermuda has not enacted an omnibus AI law comparable to the EU AI Act, nor a licensing regime for AI systems. AI is regulated indirectly through existing frameworks (data protection, financial supervision, general law) while the BMA and government develop sector- and use-specific expectations.
Data-protection backbone (PIPA)
The Personal Information Protection Act (PIPA), fully in force from 1 January 2025, is the primary binding constraint on AI systems that process personal data in Bermuda, requiring lawful basis, transparency, security and accountability. Both the Government AI Policy and BMA discussion paper anchor AI safeguards to PIPA obligations.
Judicial recognition of AI use
In January 2026 the Supreme Court of Bermuda issued a ruling widely reported as one of the first common-law endorsements of generative AI use in e-discovery, providing early judicial guidance on responsible deployment of AI in litigation rather than any statutory rule.
Public-sector deployment partnerships
In May 2026 the Bermuda Government announced a partnership with US firm NEAR AI to deploy AI across public services, implemented under the Government AI Policy's phased, human-in-the-loop and PIPA-compliant framework rather than under any new AI-specific legislation.
