Is crypto legal in United Kingdom? Rules & regulation (2026)

Crypto is developing in United Kingdom.

Crypto is legal in the UK and is currently governed by a patchwork: mandatory FCA registration for AML/CTF supervision under the Money Laundering Regulations 2017, the financial promotions regime (qualifying cryptoassets in scope since October 2023), and HMRC's existing tax treatment. A dedicated comprehensive FSMA-based regime was made into law in February 2026 but is not yet in force — the FCA authorisation gateway opens 30 September 2026, and the full regulated-activity regime (issuance of qualifying stablecoins, custody, exchanges, dealing, arranging, staking) becomes operative on 25 October 2027. Until then, most crypto activities sit outside conduct-of-business regulation other than AML and promotions rules.

Legal framework

Transitional: FCA MLR 2017 registration for cryptoasset firms (in force since Jan 2020) and FCA financial promotions regime for qualifying cryptoassets (in force since 8 Oct 2023), with the comprehensive Financial Services and Markets Act 2000 (Cryptoassets) Regulations 2026 (SI 2026/102, made 4 Feb 2026) bringing cryptoassets under FSMA — gateway opens 30 Sept 2026 and the new authorisation regime takes full effect on 25 October 2027.

Status by sub-area

  • Stablecoins

    Proposed

A dedicated regime for 'qualifying stablecoins' (FCA-regulated issuance) and for 'systemic stablecoins' (Bank of England) has been made into law in SI 2026/102 but is not yet in force — the FCA gateway opens 30 September 2026 and the regime commences 25 October 2027. Today, GBP-pegged stablecoins are not specifically regulated as financial instruments; only AML and promotions rules bite.

Still pending: Regime commences 25 October 2027; FCA gateway opens 30 September 2026

  • Exchanges / VASP

    Partial

Exchanges and other VASPs operating in the UK must currently register with the FCA under the MLR 2017 for AML/CTF supervision, but full conduct-of-business authorisation for 'operating a qualifying cryptoasset trading platform' only begins under SI 2026/102 with the gateway opening 30 September 2026 and commencement on 25 October 2027.

Still pending: Conduct-of-business authorisation regime commences 25 October 2027

  • Token Offerings

    Partial

Token offerings are not subject to a bespoke prospectus regime today. Tokens that meet the definition of a 'specified investment' (e.g. security tokens) already fall within FSMA and the public-offer/prospectus rules; pure utility/exchange tokens have only been within scope of financial promotions rules since October 2023. A dedicated admissions & disclosures regime for qualifying cryptoassets is proposed in FCA CP25/41.

Still pending: Dedicated admissions & disclosures regime proposed (FCA CP25/41), not yet enacted

  • Custody

    Proposed

Custody/safeguarding of qualifying cryptoassets is becoming a new regulated activity under SI 2026/102, requiring FCA authorisation, asset segregation and statutory trust treatment. The regime is enacted but not yet in force; today, crypto custodians are subject only to MLR registration.

Still pending: Custody regime under SI 2026/102 commences 25 October 2027

  • DeFi

    Unclear

There is no bespoke DeFi regime in the UK. The FCA's stated policy (CP25/40 / CP26/13) is to apply the new regulated-activity perimeter where there is an 'identifiable controlling entity'; 'truly decentralised' activity where no person carries on the activity by way of business falls outside the perimeter. Detailed DeFi guidance is to be consulted on later in 2026.

Still pending: Detailed DeFi guidance consultation planned for later 2026

  • Tax

    In force

HMRC treats cryptoassets as property, taxing disposals under Capital Gains Tax (18%/24% above the £3,000 annual exempt amount in 2025-26) and rewards from mining, staking and employment as income. The Cryptoasset Reporting Framework (CARF) — the UK's implementation of the OECD standard — applies to UK reporting cryptoasset service providers from 1 January 2026 with first information exchanges in 2027.

  3. Financial promotions regime applies to crypto (in force)

Qualifying cryptoassets have been within the UK financial promotions regime since 8 October 2023. Marketing to UK consumers must use one of four lawful routes (authorised person, s.21 approver, MLR-registered crypto firm, or exemption), with prescribed risk warnings, a 24-hour cooling-off period and other 'positive frictions'. Unauthorised promotion is a criminal offence.

  5. Systemic stablecoins — joint Bank of England / FCA regime

The Bank of England has published proposed rules for sterling-denominated systemic stablecoins (those scaled enough to threaten financial stability), while non-systemic qualifying stablecoin issuers will sit under the FCA's regime. HM Treasury amendments (April 2026) clarify the interaction with the Payment Services Regulations.
