Is crypto legal in Saint Lucia? Rules & regulation (2026)

Crypto is developing in Saint Lucia.

Saint Lucia enacted the Virtual Asset Business Act (Act No. 24 of 2022) in December 2022, establishing a mandatory FSRA licensing regime for all virtual asset service providers covering exchange, custody, transfer, and token-issuance activities. Crypto assets are legal but not recognised as legal tender; the Eastern Caribbean Central Bank (ECCB) does not regulate private crypto but operates the DCash CBDC as the region's sole digital legal tender and has issued public risk advisories. Updated VASP regulations and licensing guidance were published by the FSRA in January 2025.

Legal framework

Virtual Asset Business Act, 2022 (Act No. 24 of 2022); Financial Services Regulatory Authority (FSRA); Virtual Asset Business Regulations (January 2025)

Status by sub-area

  • Stablecoins

    Partial

No bespoke stablecoin legislation exists in Saint Lucia. Stablecoin issuers and service providers are captured by the general VASP licensing regime under the VABA 2022, but there are no dedicated reserve-backing, redemption-rights, or audit/attestation rules specific to stablecoins. The ECCB's DCash is the only officially recognised digital currency in the currency union.

Still pending: Bespoke stablecoin regulations (reserve-backing, redemption, audit) not yet enacted

  • Exchanges / VASP

    In force

Crypto exchanges and all VASPs must hold an FSRA licence under the Virtual Asset Business Act 2022, operative since December 2022. Requirements include minimum paid-up capital of XCD 100,000–250,000, a fit-and-proper board, a dedicated AML officer, a local representative for foreign-domiciled operators, and quarterly reporting to the FSRA.

  • Token Offerings

    In force

The VABA 2022 expressly regulates token offerings: Section 14 requires an FSRA-approved prospectus for any public offer or sale of virtual assets, and intermediaries facilitating ICOs, IEOs, or asset tokenisation must hold an FSRA licence. No separate securities-style exemption regime for small offerings has been published.

  • Custody

    In force

Custody of virtual assets for clients is a regulated activity under the VABA 2022. Licensed custodians must maintain escrow assets equal to at least 15% of client funds with a registered trust company or custodian, and are subject to FSRA oversight and quarterly reporting. No proof-of-reserves or insurance mandate has been separately enacted.

  • DeFi

    Unclear

No DeFi-specific regulations, guidance, or enforcement actions have been published by the FSRA as of May 2026. The VABA 2022's broad definition of regulated virtual asset activities could capture DeFi front-ends or intermediaries, but no DAO treatment, protocol-level framework, or formal regulatory perimeter for decentralised finance has been articulated.

Still pending: DeFi-specific regulations and DAO treatment framework not yet published by FSRA

  • Tax

    Partial

Saint Lucia levies no capital gains tax, so gains from crypto disposals are not subject to a capital-gains charge. No crypto-specific tax legislation or Inland Revenue Department guidance has been issued; general income tax principles apply to trading and business income derived from crypto activities. The territorial tax system means offshore income earned by Saint Lucia-incorporated entities may fall outside the domestic tax base.

Still pending: Crypto-specific tax guidance or legislation from Inland Revenue Department not yet issued
