Is crypto legal in Gabon? Rules & regulation (2026)

Crypto is developing in Gabon.

Gabon relies entirely on CEMAC-level regulation and has enacted no domestic crypto-specific law. Banks, microfinance institutions, and payment service providers are prohibited from facilitating any cryptocurrency transactions under COBAC Decision D-2022/071. CEMAC's 2022 Financial Market Regulation creates a nascent VASP and ICO approval framework under COSUMAF, but implementing instructions remain unpublished as of May 2026, while BEAC has publicly opposed private crypto adoption and is developing a sovereign digital CFA franc instead.

Legal framework

CEMAC supra-national regulation: COBAC Decision D-2022/071 (6 May 2022) prohibiting financial institutions from handling crypto-assets; CEMAC Regulation No. 01/22/CEMAC/UMAC/COSUMAF (July 2022) introducing VASP/ICO provisions; overseen by BEAC (central bank), COBAC (banking supervisor), and COSUMAF (capital-markets regulator). Gabon has no standalone domestic crypto statute.

Status by sub-area

  • Stablecoins

    Proposed

No private stablecoin issuance is authorised in the CEMAC zone. BEAC is developing a sovereign digital CFA franc pegged 1:1 to the CFA franc as an alternative; a regulatory framework for private stablecoins has been signalled but not yet gazetted.

Still pending: Regulatory framework for private stablecoins signalled but not yet gazetted

  • Exchanges / VASP

    Partial

CEMAC Regulation 01/22 designates COSUMAF as the VASP licensing authority, but implementing instructions have not been published, meaning no exchange has been approved. COBAC D-2022/071 simultaneously bars regulated banks from providing fiat on/off ramps, blocking practical exchange operations.

Still pending: COSUMAF implementing instructions for VASP licensing not published; bank fiat ramps prohibited

  • Token Offerings

    Partial

CEMAC Regulation 01/22 introduces an ICO framework requiring COSUMAF approval and prospectus-equivalent disclosure, treating token offerings similarly to securities. Implementing rules have not been published and no offering has been approved under this regime.

Still pending: ICO implementing rules not yet published; no offerings approved under CEMAC Regulation 01/22

  • Custody

    None

No custody-specific rules for digital assets exist in Gabon or at CEMAC level. COBAC D-2022/071 explicitly prohibits regulated institutions from holding crypto-assets for themselves or on behalf of clients, eliminating any form of institutional custody.

  • DeFi

    None

No DeFi-specific regulatory framework exists in Gabon or at CEMAC level. BEAC has expressed broad opposition to decentralised crypto activity and has not proposed any rules for protocols, DAOs, or DeFi front-ends.

  • Tax

    Partial

Gabon imposes no dedicated crypto tax. Profits from crypto trading are taxable as ordinary income under Gabon's General Tax Code. No specific capital-gains rate, VAT/GST exemption or charge, staking/airdrop rules, or mandatory crypto-asset reporting regime has been enacted.

Still pending: No dedicated crypto tax regime; profits taxable as ordinary income without specific rules

Key points: crypto & digital assets in Gabon

  1. COBAC banking ban (D-2022/071)

COBAC Decision D-2022/071 of 6 May 2022 prohibits all COBAC-supervised entities, banks, microfinance establishments, and payment institutions, from acquiring, holding, transferring, or converting crypto-assets for their own account or on behalf of clients. Institutions must also identify and report crypto-related transactions.

  2. COSUMAF VASP & ICO framework (partial)

CEMAC Regulation No. 01/22/CEMAC/UMAC/COSUMAF (July 2022) recognises blockchain-based securities registration and requires VASPs and ICO issuers to obtain COSUMAF approval with prospectus-equivalent disclosure, but detailed implementing instructions had not been issued as of early 2026, leaving no operational licensing pathway.

  3. BEAC opposition and digital CFA franc

BEAC Governor Yvon Sana Bangui has publicly opposed private cryptocurrencies, citing pressure on foreign-exchange reserves, and is developing a digital CFA franc on a strict 1:1 parity with the CFA franc as the sovereign alternative to private stablecoins. A harmonised BEAC/COBAC/COSUMAF crypto framework was expected for publication in 2025-2026.
