AI regulation in Argentina: laws & policy (2026)
AI in Argentina: guidelines only.
Argentina has no horizontal AI law in force. It relies on soft-law federal guidelines, a national AI strategy (ArgenIA 2019), sector- and data-protection-based supervision by the AAIP, and — since late 2025 — the first binding provincial regime in Buenos Aires for AI use in public administration. In May 2026 President Milei sent Congress a bill proposing an explicitly deregulatory AI framework alongside a new 'non-human corporation' category; it remains a draft.
Legal framework
No comprehensive federal AI statute. Governance rests on the 2019 Plan Nacional de Inteligencia Artificial (ArgenIA), non-binding federal guidelines (Disposición 2/2023 'Recomendaciones para una IA Fiable'; AAIP Resolución 161/2023), a 2025 provincial framework (Buenos Aires Res. 9/2025) and general laws (data protection Law 25.326, consumer, IP). A May 2026 executive bill on 'non-human corporations' and unregulated AI is pending in Congress.
Key points: artificial intelligence in Argentina
National AI Plan (ArgenIA, 2019)
The Plan Nacional de Inteligencia Artificial, coordinated by the then Secretariat of Science, Technology and Productive Innovation, sets strategic axes (talent, data, infrastructure, R&D, public-sector adoption, ethics/regulation) running to 2030. It is a policy strategy, not binding law.
Federal soft-law guidelines (Disposición 2/2023)
The Subsecretaría de Tecnologías de la Información issued 'Recomendaciones para una Inteligencia Artificial Fiable' on 1 June 2023 (Official Gazette, 2 June 2023). Directed at the national public sector, it applies ethical principles across the AI lifecycle and reserves accountability and oversight to humans; it is non-binding for the private sector.
AAIP Transparency & Data-Protection Programme (Res. 161/2023)
AAIP Resolution 161/2023 (published 4 September 2023) created a Programme for Transparency and Personal-Data Protection in the Use of AI, including an AI observatory, multidisciplinary advisory council, sectoral diagnostics and AI-adapted privacy-impact tools, applied under Law 25.326 (data protection).
First binding provincial regime — Buenos Aires Res. 9/2025
The Subsecretaría de Gobierno Digital of the Province of Buenos Aires enacted Resolution 9/2025 in November 2025 — the first mandatory AI framework in Argentina. It introduces a risk-tier classification (unacceptable/high/limited/zero risk), a Provincial Registry of AI Systems, audit/traceability duties and public-notice requirements when AI is used, binding public bodies of the Province.
Milei 2026 bill — 'non-human corporations' & deregulatory AI framework
On 29 May 2026 President Javier Milei sent Congress a draft creating a corporate category run by AI agents (with a human administrator still liable) alongside a commitment to keep AI 'unregulated' and a low corporate tax. The bill remains under debate in the Senate and is not enacted.
Sectoral & cross-cutting statutes filling the gap
Absent an AI law, obligations are drawn from Personal Data Protection Law 25.326 (enforced by AAIP), Consumer Protection Law 24.240, IP/Copyright Law 11.723, and sectoral rules (financial supervision by BCRA/CNV, health by ANMAT). Several federal bills to create a horizontal AI framework or an oversight body are pending in the National Congress.
